Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Florida Home Buy LLC ("Company," "we," "us," or "our") governing your access to and use of our website, services, and any related communications.

By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.

Description of Services

Florida Home Buy LLC provides turnkey project management services for modular home construction in Florida. Our services include:

• Lot acquisition assistance and site analysis
• Permitting coordination and Florida Building Code compliance guidance
• Financing facilitation through our lending partners
• Construction coordination and project oversight
• Quality control and project timeline management

We act as project managers and facilitators. We are not licensed general contractors, real estate agents, or mortgage lenders. Construction services are provided by our licensed construction partner, Lagana Properties. Financing is provided through our lending partner, HIS Capital Funding.

Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts to use our services. By using our services, you represent and warrant that you meet these eligibility requirements.

Service Fees and Payment

Project Management Fee: Our standard project management fee is $5,000. The VIP Multi-Project package is $10,000 for 3 project slots.

Fee Credit: Project management fees are credited back to you at closing when you purchase a lot and/or complete construction through our network of partners. The specific terms of the fee credit will be outlined in your service agreement.

Additional Costs: You will be responsible for all costs associated with your modular home project, including but not limited to: land purchase, construction costs, permits, utility connections, financing costs, and closing costs. These costs are separate from our project management fee.

Payment Terms: Specific payment terms, including deposit requirements and payment schedules, will be outlined in your individual service agreement.

Client Responsibilities

As a client, you agree to:

• Provide accurate and complete information
• Respond to communications in a timely manner to avoid project delays
• Make timely payments as outlined in your service agreement
• Comply with all applicable laws and regulations
• Obtain necessary approvals, permits, and financing as required
• Review and approve project decisions within agreed timeframes

Limitation of Services

Our role is limited to project management and coordination. We do not:

• Guarantee financing approval or specific loan terms
• Guarantee permit approval or specific timelines
• Provide legal, tax, or investment advice
• Guarantee specific property values or investment returns
• Perform actual construction work (provided by licensed contractors)

Communications and Consent

Electronic Communications

By providing your contact information, you consent to receive electronic communications from us, including emails and text messages regarding your project, service updates, and marketing communications.

SMS/Text Message Terms

By opting in to receive text messages from Florida Home Buy LLC, you acknowledge and agree to the following:

• You consent to receive automated text messages at the phone number provided
• Message frequency varies; you may receive up to 4 marketing messages per month
• Message and data rates may apply based on your carrier plan
• You may opt out at any time by replying STOP to any message
• Text HELP to any message for assistance, or contact [email protected]
• Consent to receive text messages is not required to purchase services
• We will not share your phone number with third parties for marketing purposes

Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Florida Home Buy LLC or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without our express written permission.

Disclaimer of Warranties

OUR WEBSITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that our website will be uninterrupted, error-free, or secure, or that any defects will be corrected. We make no warranties regarding the results of our services or the accuracy of any information provided.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLORIDA HOME BUY LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OUR WEBSITE OR SERVICES.

Our total liability for any claims arising under these Terms shall not exceed the amount of fees you have paid to us in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Florida Home Buy LLC, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of our services, your violation of these Terms, or your violation of any third-party rights.

Dispute Resolution

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

Informal Resolution: Before filing any legal claim, you agree to attempt to resolve any dispute informally by contacting us at [email protected]. We will attempt to resolve the dispute within 30 days.

Jurisdiction: Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Pinellas County, Florida, and you consent to the personal jurisdiction of such courts.

Termination

We may terminate or suspend your access to our services at any time, with or without cause, with or without notice. Upon termination, your right to use our services will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after any changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and any service agreement you enter into with us, constitute the entire agreement between you and Florida Home Buy LLC regarding your use of our website and services, and supersede any prior agreements.
